PRODUCT LIABILITY WAIVER, RELEASE, ASSUMPTION OF RISK,
WARRANTY DISCLAIMER, AND LIMITATION OF LIABILITY AGREEMENT

1. WHO THIS AGREEMENT COVERS
This Agreement applies to the purchaser, any end user, and any person who sets up or applies the device.
2. PRODUCT DESCRIPTION AND MEDICAL DISCLAIMER
The WellnessBox is an electrical stimulation device intended for general wellness and recovery use as described in the official instructions. It is not emergency care and is not a substitute for medical diagnosis or treatment. If you believe you are experiencing a medical emergency, call 911 or your local emergency number immediately.
3. SAFETY WARNINGS AND CONTRAINDICATIONS
DO NOT USE this device if you have a pacemaker, implanted defibrillator, neurostimulator, or other implanted medical device; are pregnant; have epilepsy or a serious heart condition; or have broken or infected skin at the electrode site unless approved by a licensed medical professional.
NEVER PLACE ELECTRODES on the front of the neck, across the chest/heart, on the head or face unless specifically instructed, on genitals, or on broken/inflamed skin.
Stop use immediately if you experience burning, dizziness, chest pain, irregular heartbeat sensation, fainting, or severe discomfort.
4. ASSUMPTION OF RISK
You understand that electrical stimulation involves inherent risks including skin irritation, redness, muscle soreness, electrical burns, and injury from improper placement or excessive intensity. You voluntarily assume all known and unknown risks arising from possession, setup, or use of the device.
5. USER RESPONSIBILITIES
You agree to read and follow all instructions, use only approved accessories, avoid use while sleeping, driving, bathing, or near water, avoid contraindicated medical conditions, supervise minor use, and discontinue use upon discomfort.
6. RELEASE AND WAIVER OF CLAIMS
To the maximum extent permitted by law, you release and discharge WellnessBox and its members, agents, suppliers, and contractors from any claims arising from misuse, failure to follow instructions, use despite contraindications, unauthorized modifications, use with non-approved accessories, or continued use after warning symptoms. This release includes claims alleging negligence, except where prohibited by law including fraud or willful misconduct.
7. DISCLAIMER OF WARRANTIES
EXCEPT FOR ANY EXPRESS WRITTEN LIMITED WARRANTY PROVIDED SEPARATELY, THE PRODUCT IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELLNESSBOX DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by law, WellnessBox shall not be liable for indirect, incidental, special, consequential, or punitive damages. Total aggregate liability shall not exceed the purchase price paid for the device. Some jurisdictions do not allow certain limitations related to personal injury, so these limitations may not apply to you.
9. INDEMNIFICATION
You agree to indemnify and hold WellnessBox harmless from third-party claims arising from misuse, unauthorized modifications, violation of instructions, or unlawful conduct.
10. GIFTS AND ADDITIONAL USERS
If you purchase this product for another person, you must provide them all instructions and warnings. Each end user must accept this Agreement before use.
11. MINORS
You must be at least 18 years old to purchase the product. If a minor uses the device, adult supervision is required and responsibility remains with the supervising adult.
12. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with applicable federal law of the United States and, to the extent not preempted, the laws of the state in which WellnessBox maintains its principal place of business, without regard to conflict-of-law principles. Venue for any action not otherwise required by law shall lie in the courts located in the state of WellnessBox’s principal place of business.
13. ELECTRONIC ACCEPTANCE
By clicking “I Agree,” placing an order, activating the device, or using the product, you acknowledge that you have read this Agreement, understand it, agree to be legally bound, and consent to electronic signature.
14. SEVERABILITY
If any provision is found unenforceable, it shall be modified to the minimum extent necessary, and the remainder of the Agreement shall remain in full force.
